Terms of Service

These Terms of Service ("Terms") govern your use of the Foosma mobile application and related services ("Service"), operated by Dynaspirits Design Inc. ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Your account

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Foosma.
You are responsible for keeping your sign-in credentials secure and for all activity under your account.
You must provide accurate account information and keep it up to date.

2. Your content

Foosma lets you upload photos and write ratings, reviews, and other content ("User Content"). You retain ownership of your User Content.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display your User Content solely to operate and improve the Service (for example, storing your photos, running AI analysis on them, and rendering your meal map).
You are responsible for your User Content. Do not upload content that is unlawful, infringes others' rights, contains personal data of others without consent, or is abusive, hateful, or deceptive.
Ratings and reviews must reflect your genuine experience. Do not post fake, paid-for, or misleading reviews.
We may remove User Content that violates these Terms and may suspend or terminate accounts for repeated or serious violations.

3. AI-generated content disclaimer

Foosma uses artificial intelligence to estimate dish names, ingredients, nutrition values, health scores, and pairing suggestions from your photos. These are automated estimates and may be inaccurate or incomplete. They are provided for general informational purposes only and are not medical, nutritional, dietary, or health advice. Do not rely on them for allergy, medical, or dietary decisions — always verify ingredients yourself and consult a qualified professional for health guidance.

4. Acceptable use

You agree not to:

Use the Service for any unlawful purpose;
Probe, scan, overload, or disrupt the Service or circumvent rate limits or security measures;
Access the Service with automated means (scraping, bots) except through interfaces we provide;
Reverse engineer the app except where permitted by law;
Impersonate others or misrepresent your affiliation.

5. Privacy

Our Privacy Policy describes what data we collect and how we use it, including third-party AI processing of your meal photos. By using the Service you acknowledge that processing.

6. Termination

You may stop using the Service at any time and may delete your account in-app (see account deletion).
We may suspend or terminate your access if you materially violate these Terms, if required by law, or if we discontinue the Service. Where reasonable, we will give you notice.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content (including AI output) is accurate.

8. Limitation of liability

To the maximum extent permitted by law, Dynaspirits Design Inc. and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Changes to the Service or Terms

We may modify the Service or these Terms. If we make material changes to the Terms, we will update this page and the date above and, where appropriate, notify you in the app. Continued use after changes take effect constitutes acceptance.
